FREIGHT FARMS PRIVACY POLICY FOR SOFTWARE PRODUCTS

1. Introduction
Freight Farms (“Company”, “we” “us” “our” etc.) respect our user’s (“User”, “you” “your” etc.) privacy, and is committed to protecting it through our compliance with this Privacy Policy for Software Products (Policy).

A. This Policy describes:

  • The types of information we may collect or that you may provide when you access or use our software and/or services (the “Product(s)”) and

  • Our practices for collecting, using, maintaining, protecting, and disclosing that information.

B. This Policy DOES NOT apply to information that:

  • We collect offline or on any other Company websites or

  • You provide to or is collected by any third party (other than as expressly specified in this Policy).

C. Please read this Policy carefully to understand our policies and practices regarding your information and how we will use and secure it. If you do not agree with the terms of this Policy, please refrain from using the Products. By using the Products, you are agreeing to the terms of this Policy.

D. We may revise this Policy from time to time, in which case the “last modified” date will be updated. Your continued use of the Products after we make changes shall be deemed your acceptance of such changes, and you should therefore check this Policy periodically.

2. Information We Collect and How We Collect It

A. We collect information from and about users of the Products as follows:

  • Directly from you when you provide it to us and

  • In some cases, automatically when you use the Products.

B. The information we collect includes:

  • Information that you provide by filling in forms related to the Product. This includes information provided at the time of creating your account and/or downloading or ordering Products

  • Records and copies of your correspondence (including email addresses and phone numbers), if you contact us

  • Details of transactions you carry out with use, including through your use of the Product and related to the fulfillment of your orders or support requests.

C. Credit card and other financial information submitted by you (if any) for Products purchased via this account are governed by the Stripe Privacy Policy.

D. When you use the Product, we may ask you to provide certain contact information. This contact information is not considered personal information. For the purposes of this Policy, the contact information we may ask you to provide includes your email address, your first and last name, a mailing address (if we will be shipping Products to you), and a phone number (collectively, Contact Information).

3. Consent to Processing Outside the United States

By using our Products, or providing Contact Information to us, you understand and unambiguously consent to the collection, use, disclosure and retention of information in the United States for the purposes set forth in this Policy and any Product terms of service accompanying our Products. You hereby consent to the collection, use, disclosure, and retention by us of your Contact Information as described under this Policy, including but not limited to the transfer of your Contact Information between us and the third parties, affiliates, and subsidiaries described in this Policy. For further certainty, any consent relating to a right to transfer Contact Information referred to in this paragraph shall be deemed to include your consent to the transfer of the applicable Contact Information to a jurisdiction which may provide a different level of privacy protection than that available in your own country.

4. Automatic Information Collection and Tracking

A. When you download, access, or use a Product, the Product and our related systems may gather certain information automatically and store it in log files. This information, which does not identify you, includes Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. We may use this information to identify user habits and improve the functionality of the Products and your interaction with us as a result of our observations.

B. We also collect farm data, climate data, sensor and other information related to your farm. If you are a Freight Farm farmer, we may aggregate this information and use it for our business purposes.

5. Cookies

We use cookies to passively store information about your use of the Products, including your preferences and other session information. A cookie is a small text file stored on your computer. You may be able to configure your browser to accept or reject all or some cookies, or notify you when a cookie is set. However, you may be required enable cookies in order to use certain features of your account and the Products available via the account.

We use cookies to confirm that users are logged in. By default, these cookies will persist until you choose to explicitly log out. When you log in, you may choose not to stay logged in after you close the browser, in which case the cookies used to identify your logged-in status will terminate once you close your browser. We do not store your password in any cookies. Most Internet browsers enable users to erase cookies from their computer’s hard drive, block all cookies, or receive a warning before a cookie is stored. Please refer to your browser instructions or help screen to learn more about these functions.

6. Third Party Tracking

We rely on certain third-party services to make the Products available, and in some cases, these third parties may use tracking technologies in connection with your account and Product usage, which may include the collection of information about your online activities over time and across third-party websites or online services. We do not control those tracking technologies and we are not responsible for them. However, you consent to potentially encountering third-party tracking technologies in connection with your use hereunder, and accept that our statements under this Policy do not apply to the tracking technologies or practices of such third parties.

7. Use of Your Information

A. We may use information that we collect about you or that you provide to us, including Contact Information, to:

  • Provide you with the Products and associated content, and any other information, products or services that you request from us.

  • Fulfill any other specific purpose for which the information was provided.

  • Give you notices about your account including expiration and renewal notices.

  • Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

  • Notify you when Product updates are available, and of changes to any products or services we offer or provide through it.

  • To contact you about our own or third parties’ goods and services that may be of interest to you. If you do not want us to use your information in this way, please either unsubscribe when you receive these communications, or if available in your account, adjust your user preferences in your account profile.

B. The usage information we collect helps us to improve our Products and to deliver a better and more personalized experience by enabling us to:

  • Store information about your preferences, allowing us to customize our Products according to relevant interests.

  • Speed up your access to the Products.

  • Recognize you when you use the Products.

8. Disclosure of Your Information

We may disclose aggregated information about our users, and information that does not identify any individual or device, without restriction. In addition, we may disclose Contact Information that we collect or you provide:

  • To our subsidiaries and affiliates.

  • To contractors, service providers, and other third parties we use to support our business, including those that are identified in this Policy.

  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Company’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Contact Information and other information held by Company about our Product users is among the assets transferred.

  • To fulfill the purpose for which you provide it or for any other purpose disclosed by us when you provide the information.

  • With your consent.

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.

  • To enforce our rights arising from any contracts entered into between you and us, including any services’ agreement, and for billing and collection.

  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our customers or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

9. Your Choices About Marketing and Promotional Activities

If you do not want us to use your email address or Contact Information to promote our own or third parties’ products or services, you can opt-out by unsubscribing to our marketing emails.

10. Accessing and Correcting Your Contact Information

You can review and change your Contact Information by logging into your account and visiting your account profile page.

You may also send us an email at support@freightfarms.com to request access to, correct, or delete any Contact Information that you have provided to us. We cannot delete your email address except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

11. Your California Privacy Rights

California Civil Code Section 1798.83 permits users of our Products who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. We do not currently collect personal information or disclose such information to third parties however, you should please email us at support@freightfarms.com if you have questions about these rights. 12. Data Security

We strive to maintain the reliability, accuracy, completeness and currency of your information in our databases and to protect the privacy and security of our databases and the data we collect. Any information that you provide to us will be stored on third party servers (currently including MLAB, Heroku.com, SFDC and AWS). We maintain reasonable physical, electronic and procedural safeguards to protect the confidentiality of your information. The security measures in place are designed to protect the loss, misuse or alteration of the information you provide to us.

13. Changes to Our Privacy Policy

We may update this Policy from time to time. If we make material changes to how we treat our users’ information or the kinds of information we collect, we will post the new Policy on this page.

The date the Policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you and for periodically visiting this Policy to check for any changes.
